GENERAL TERMS AND CONDITIONS

General Terms and Conditions of the partnership company Meibert & Michalak, further referred to as “Mindfulness Institute Ruhr”

 

§ 1 Scope of application
These general terms and conditions (hereinafter referred to as “GTC”) apply to all seminars and training courses that are carried out by the Mindfulness Institute Ruhr.

 

§ 2 Conclusion of contract
The contract is concluded by sending the registration form provided by the Mindfulness Institute Ruhr and the down payment of an amount of € 50.00 by the participant and the subsequent confirmation of registration sent by the Mindfulness Institute Ruhr.

 

§ 3 Participation fees
(1) The participation fees must be paid no later than 14 days before the start of the seminar or further training after receipt of the invoice.

(2) In the case of further training as an MBSR teacher, the individual payment modalities shown in the respective registration forms apply. With his/her signature, the participant accepts the contract as binding. If several payment alternatives are offered in the registration form, the participant makes a binding decision by ticking one of the offered alternatives, which is confirmed again in the registration confirmation. The participation fees are to be paid according to the agreed and confirmed payment arrangements after receipt of the invoice.

 

§ 4 Mandatory information required from participant
(1) The participant is obliged to provide truthful information in the registration form. In the case of subsequent changes to data, in particular name, address, email address, telephone number, the participant undertakes to notify the Mindfulness Institute Ruhr immediately of these changes.

(2) If the participant fails to provide this information or if he/she provides incorrect data from the outset, in particular an incorrect email address, the Mindfulness Institute Ruhr can withdraw from the contract insofar as a contract has been concluded. The withdrawal is declared in text form (e.g. by letter, fax or email).

 

§ 5 Withdrawal by the participant
(1) The participant can withdraw from the contract at any time prior to the start of the seminar or further training by means of a declaration in text form to the Mindfulness Institute Ruhr.

(2) If the participant withdraws before the start, the Mindfulness Institute Ruhr loses the right to the participation fee. Instead, the Mindfulness Institute Ruhr can request adequate compensation, provided that the Mindfulness Institute Ruhr is not responsible for the resignation. The cancellation fees are compounded in § 5 section 3.

(3) The flat rate claim for cancellation fees is:

– up to 30 days before the start € 50.00

– 50% of the participation fee from the 29th day before the start

– 100% of the participation fee from the 10th day before the start

If there is a waiting list and the place can be allocated to another participant, a processing fee of € 50.00 will be charged.

(4) In case of the obligation to pay the entire participation fee, the participant is entitled to provide proof that the Mindfulness Institute Ruhr has suffered no damage or less damage.

(5) Partial / daily withdrawal from a seminar or further training is not possible.

(6) The conditions of withdrawal for further training as an MBSR-teacher result from the respective registration form. By registering, the participant accepts them as binding.

(7) The conditions of withdrawal with regard to accommodation and meals in a seminar house are given in the respective registration form.

 

§ 6 Cancellation of Seminars and Further Training
(1) Seminars and further training courses can be cancelled for important reasons (e.g. if the number of participants is too low, if a speaker is absent or ill or due to circumstances out of our control). If the number of participants is too low, the cancellation will be made no later than two weeks before the start of the event.

(2) In all other cases, the Mindfulness Institute Ruhr will inform the participants as soon as possible. If, on exception, a seminar or further training has to be cancelled or postponed, the participation fees will be refunded immediately. Further claims are excluded. This does not apply in cases of willful or grossly negligent behaviour of the legal representatives, employees or other vicarious agents of the Mindfulness Institute Ruhr.

 

§ 7 Liability
(1) The Mindfulness Institute Ruhr is liable in all cases of contractual and non-contractual liability in the event of intent and gross negligence in accordance with the statutory provisions for compensation or reimbursement of futile expenses.

(2) In other cases, the Mindfulness Institute Ruhr – unless regulated otherwise in Paragraph 3 – is only liable in the event of a breach of a contractual obligation, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the participant can regularly rely (so-called cardinal obligation) , limited to the replacement of the foreseeable and typical damage. In all other cases, liability is excluded subject to the provision in paragraph 3.

(3) Liability for damage from injury to life, body or health remains unaffected by the above-mentioned limitations of liability and exclusions of liability.

 

§ 8 Copyright
The working documents of the Mindfulness Institute Ruhr are protected by copyright and may not be reproduced or distributed in whole or in part without the consent of the Mindfulness Institute Ruhr. The Mindfulness Institute Ruhr reserves all rights. The working documents are exclusively available to the participants.

 

§ 9 Cancellation policy and form for consumers
You have the right to cancel the contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day the contract is concluded.

In order to exercise your right of cancellation, you must inform us (Mindfulness Institute Ruhr, Laurastraße 87, 45289 Essen, phone 0201-59808068, fax: 0322-29352163, email: info@achtsamkeitsinstitut-ruhr.de) by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to cancel this contract. You can use the attached sample cancellation form, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send your notification regarding the exercise of the right of cancellation before the cancellation period expires.

Consequences of cancellation
If you cancel this contract, we have to repay all payments that we have received from you immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.

If the service begins during the cancellation period, you have to pay a reasonable amount after exercising your right of cancellation. Adequate is the amount that corresponds to the share of the services already provided up to this point in comparison to the total scope of the services provided in the contract. The decisive factor is the time at which we receive notification of your cancellation of this contract.

§ 10 Severability clause and agreement on jurisdiction
(1) If one or more provisions of these General Terms and Conditions are or become wholly or partially ineffective, if these General Terms and Conditions contain a loophole, this does not affect the effectiveness of these General Terms and Conditions.

(2) If the participant is an entrepreneur, the place of jurisdiction for all disputes between the participant and the Mindfulness Institute Ruhr is Essen.

(3) The aforementioned jurisdiction agreement also applies to consumers if they do not have a general place of jurisdiction in Germany.
